Terms and conditions

1. Scope

These terms and conditions apply to all enquiries, offers and contracts between Bach Maschinenhandel, owner Frank Bach, Ünninghauserstr. 20, 59556 Lippstadt, Germany, and consumers or businesses through this online shop.

2. Contract formation

The product presentations on the website are not binding offers. They invite you to submit an enquiry or, where checkout is available, to place a binding order. For products marked "Ask about this item", you can submit an enquiry using the enquiry form. We will then send you an individual offer or clarify the details. A contract is formed only when you accept our offer or when we expressly accept your order. The relevant contract language is English unless the parties agree otherwise.

3. Prices and shipping

The prices and any applicable delivery or shipping charges are shown in the respective offer or order information. Unless otherwise stated, statutory taxes apply. Further details on delivery are provided before the contract is concluded.

4. Payment

Available payment methods and any applicable conditions are shown during the ordering or offer process. Payment is due according to the payment information communicated with the offer or order confirmation.

5. Delivery

Delivery dates and conditions are stated in the relevant offer or order confirmation. If an item is unavailable, we will inform you without undue delay.

6. Retention of title

For consumers, the goods remain our property until the purchase price has been paid in full. For businesses, the goods remain our property until all claims arising from the ongoing business relationship have been settled, subject to applicable law.

7. Defects and used goods

Statutory liability for defects applies. Used goods are identified as such in the relevant product description or offer. The condition, known defects, included accessories and functional scope stated there form part of the agreed condition of the goods. Statutory consumer rights remain unaffected. A guarantee exists only if it is expressly designated and granted as such.

8. Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, and liability under mandatory law. In cases of slight negligence, we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for the contract. This does not affect mandatory consumer rights.

9. Right of cancellation

Consumers have a statutory right of cancellation. Details, conditions and the model cancellation form are set out in our cancellation policy.

10. Data protection

We process personal data in accordance with our privacy policy.

11. Alternative dispute resolution

The European Commission’s online dispute resolution platform has been discontinued. We are not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board, unless a statutory obligation applies.

12. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections of the law of the country in which they have their habitual residence. The statutory place of jurisdiction applies to consumers. The place of jurisdiction for businesses is Lippstadt, Germany.
